Elective PTET
Yes
The General Assembly's bill summary says the SALT Parity Act, for income tax years commencing on or after January 1, 2022, allowed pass-through entities to elect to pay state income tax at the entity level.
Who can elect
An S corporation or a partnership.
Senate Bill 22-124 states those entities in section 39-22-343.
How the election is made
An S corporation or partnership elects annually on the return filed under section 39-22-601. Filing that return is binding on all electing pass-through entity owners.
For income tax years commencing on or after January 1, 2018, and before January 1, 2022, the act instead required a composite amended return between September 1, 2023, and July 1, 2024. That window is not the 2026 rule.
Election deadline
On the return filed under section 39-22-601. Senate Bill 22-124 does not state a calendar date for a year commencing on or after January 1, 2022.
The act states the return filing and does not state a 2026 calendar date.
Rate
Senate Bill 22-124 amends section 39-22-344 so the tax equals the rate in section 39-22-301 for the applicable income tax year, multiplied by the resident and Colorado-source amounts the section describes. The act does not state the 2026 percentage in section 39-22-301.
The signed act replaces a stated percentage with the section 39-22-301 cross-reference.
Owner relief
For income tax years commencing on or after January 1, 2018, section 39-22-347 allows the owner a credit equal to that owner's share of the tax imposed under section 39-22-344(1). The credit is allowed only if the entity paid the tax and identified the owner. Any amount that exceeds the owner's income tax is refunded.
The signed act adds section 39-22-347.
Estimates
For income tax years commencing on or after January 1, 2023, an electing pass-through entity is treated as a corporation under section 39-22-606 for estimated payments. Senate Bill 22-124 does not state the installment dates.
The act says the estimate requirement does not apply for income tax years commencing prior to January 1, 2023.
Sunset or repeal
Not verified. Senate Bill 22-124 amends section 39-22-343(1) and refers to subsection (2). The signed act does not restate subsection (2), so no end date was taken from it.
