Nebraska PTET 2026: deadline, rate, who can elect

Nebraska (NE), tax year 2026, from the same rules the connector returns. Last verified October 24, 2026.

Informational. Not tax advice.

Elective PTET

Yes

An eligible partnership or S corporation may elect Nebraska income tax for tax years beginning on or after January 1, 2018.

Who can elect

An eligible partnership or S corporation.

The page uses those terms and does not further define them.

How the election is made

For a year after 2022, file Form PTET-E or check box 5 on the applicable return. Box 5 must be checked even if Form PTET-E was filed. The election is irrevocable and cannot be changed on an amended return.

The page says the election binds the entity and its owners.

Election deadline

For tax years beginning on or after January 1, 2023, the election is made on the applicable income tax return on or before the due date, including any extensions that have been granted. Sections 77-2727 and 77-2734.01 do not state a 2026 calendar date.

The December 30, 2025 date on the Department page is only for tax years 2018 through 2022.

Rate

The Department's PTET FAQ states a 4.55 percent rate for 2026 and 3.99 percent for 2027 and after. Sections 77-2727 and 77-2734.01 tax an electing partnership or electing small business corporation at the highest individual rate in section 77-2715.03. For taxable years beginning on or after January 1, 2026, and before January 1, 2027, section 77-2715.03 sets rate four, the top bracket, at 4.55 percent.

The FAQ table lists 2026 separately from 2025.

Owner relief

A refundable credit equal to the owner's pro rata or distributive share of the Nebraska income tax paid by the electing partnership or electing small business corporation. For tax returns for years beginning on or after January 1, 2022, the credit is allowed for the same taxable year as the election.

Sections 77-2727 and 77-2734.01 state that credit.

Estimates

For tax years after 2023, the Department's PTET FAQ says a PTE must make estimated payments when its PTET liability after credits is $400 or more. The FAQ does not state installment dates. Sections 77-2727 and 77-2734.01 treat an electing entity as a corporation under section 77-2769 and say that requirement does not apply for tax years beginning before January 1, 2024. Those sections do not state the installment dates.

The $400 rule is in the FAQ. Section 77-2769 was not read.

Sunset or repeal

Sections 77-2727 and 77-2734.01 do not state an end date. Each allows an annual election for tax years beginning on or after January 1, 2018.

The election subsections were read through the credit rules.
