Elective PTET
Yes
A pass-through entity may elect to file the IT 4738 as an electing pass-through entity.
Who can elect
The instructions say a disregarded entity cannot elect. The election includes all owners' qualifying taxable income and is binding on all owners.
The instructions do not give a longer entity list in the highlights used here.
How the election is made
Timely file the IT 4738 or the EPTE-ELEC form. The election is irrevocable for the taxable year.
The instructions say that is how the Department is told of the election.
Election deadline
A timely IT 4738 or EPTE-ELEC. The IT 4738 is due April 15 of the calendar year after the year in which the entity's fiscal year ends.
The instructions give the 2025 return as an example: a year ending in 2025 is due April 15, 2026.
Rate
3 percent for PTE taxable reporting periods beginning in 2023 and thereafter.
The 2025 instructions state that rate.
Owner relief
A refundable credit against the taxpayer's aggregate tax liability under section 5747.02 is allowed for an owner of an electing pass-through entity. The credit equals the owner's proportionate share of the lesser of the tax due or paid under section 5747.38 for the entity's taxable year that ends in the taxpayer's taxable year. The credit is claimed for the taxpayer's taxable year that includes the last day of that entity year. If the credit exceeds the tax otherwise due, the excess shall be refunded.
R.C. 5747.39. The section says the commissioner may request information, and no credit is allowed unless the requested information is provided.
Estimates
For taxable years beginning on or after January 1, 2026, estimates are due on the 15th day of the fourth, sixth, and ninth months after the year begins and the 15th day of the first month of the following year.
The instructions say the prior quarterly schedule changes on that date.
Sunset or repeal
For an electing pass-through entity's taxable year that begins in 2023 and in any year thereafter, section 5747.38 levies the tax at the rate imposed on taxable business income under section 5747.02(A)(4)(a). The section, read through division (F), does not state an end date.
Division (B)(2) is the continuing rate sentence. Division (F) is the last division on the page.
