Elective PTET
Yes
HB 444 allows a pass-through entity to elect to pay Utah income tax on voluntary taxable income for its final pass-through entity taxpayers.
Who can elect
An S corporation, an estate or trust, or an entity classified as a partnership. A disregarded entity cannot elect. The election applies to every final individual owner and does not apply to a business entity or an estate or trust owner.
A final owner cannot opt out.
How the election is made
File a SALT report and pay the SALT tax electronically through Taxpayer Access Point on or before the last day of the entity's taxable year.
The report is Form TC-75. Both the report and the payment are required for a valid election.
Election deadline
On or before the last day of the pass-through entity's taxable year. For a year ending December 31, the payment must be made by December 31. A later payment is refunded and is not a valid election.
The FAQ says the election is irrevocable once a valid payment is made.
Rate
Voluntary taxable income of all final owners multiplied by the individual income tax rate for the taxable year. The FAQ does not state a percentage.
Voluntary taxable income is Utah-resident PTE income and Utah-source income attributed to a nonresident individual.
Owner relief
A nonrefundable credit on the individual return for the tax paid.
The TC-75 instructions and the FAQ describe that credit.
Estimates
Quarterly prepayments are not required. The election is valid to the extent the tax is paid and the SALT report is filed by the last day of the taxable year.
The FAQ answers the prepayment question directly.
Still open in the source review
- The FAQ says the tax is the individual income tax rate for the year. It does not state a percentage.
